The General Terms and Conditions below also apply to the Nationale Kunstdagen. In that case ‘De Kunst Collega’s’ should be read as follows: Stichting Kunstweek.

The General Terms and Conditions for Cancellation Protection

1. General
a. If an artist has applied to participate in an art fair organised by De Kunst Collega’s, something may happen which makes it necessary for the participant to cancel his participation in the fair. In these General Conditions the conditions are laid down that apply to arranging and having a cancellation protection.
b. The cancellation protection makes a payment of the participation costs (with the exception of the registration costs and an own risk) if a registration for participation in an art fair must be cancelled by the participant for a reason covered by this cancellation protection.
c. The cancellation protection (hereinafter ’the protection’) only applies for the art fair for which it is agreed, namely one of the following four art fairs: the EuropArtFair, the Nationale Kunstdagen (organised by Stichting Kunstweek), Art Eindhoven or the Brabant Art Fair.

2. Regulations
a. Protection will be arranged via the registration form for participation in the relevant art fair, therefore at the same time as the application for participation.
b. The arranged protection is irrevocable. This means that the protection remains in place up to and including the last day of the fair, that any charges due for the protection must always be paid and that any charges paid are not refunded.
c. If the participant is only unable to participate in part of the fair (e.g. one or two days depending on the duration of the fair), then the protection will only reimburse the part that cannot be participated in (33% if the participant cannot participate in one day of a three-day fair, 50% if the participant cannot participate in one day of a two-day fair).

3. Payment
a. Protection pays the participant the full participation costs (not the registration costs) including VAT, which at the time of cancellation have been paid by the participant, less € 100 (excluding VAT) own risk. If the participation fee owed has not yet been paid, the full participation fee (not the registration fee) including VAT that is owed by the participant at the time of cancellation will be credited, less € 100 (excluding VAT) own risk.
b. The right to a payment or credit will lapse if the cancellation is not reported within five days of the reason for the cancellation occurring.
c. Notification of cancellation must be made by e-mail to the e-mail address of the relevant exhibition, stating the reason for cancellation.
d. Reasons for cancellation that are covered by the protection are illness of the participant (a doctor’s certificate is required, from a doctor other than the general practitioner), death of a family member in the first degree, serious events in the immediate vicinity, in particular a burglary in one’s own home, storm damage or fire. For example, if a car does not start, a child has to take an exam, other work is given priority or a pet has died and artist wishes to cancel participation, the protection does not pay out.

4. Costs
a. The costs for protection amount to 5% of the total costs owed for registration and participation in the fair.
b. The person registering for protection will have the costs of protection stated on his/her invoice for participation.
c. The protection starts at the moment of registration, payment of the protection costs takes place at the same time as the costs for participation.
d. If at the time of cancellation the participation costs have not yet been paid, the protection costs must still be paid, together with the own risk. The person cancelling the participation will receive an invoice for this.
e. If the costs are not paid within the payment term set by the fair in question, the person taking out the protection loses the right to a payment in the event of cancellation of participation.

5. Other conditions
a. The reason for cancellation must be unknown at the time of concluding the protection. It must also be unforeseeable at the time when the protection is concluded.
b. These General Provisions are not a complete record of all circumstances that may arise in relation to the protection.
c. In the event that any provision in these General Terms and Conditions is not applicable, the other provisions will remain applicable.
d. The protection can only be concluded by adults.
e. The protection is not insurance in the sense of the law.
f. In cases not provided by these General Terms and Conditions, the judgement of De Kunst Collega’s applies.
